Roaming Photography Service Agreement

SERVICE PERIOD:

The Service Period will be the date and times listed on this contract. Any change in the date will incur a $50 fee. 29PM Photo Booth agrees to have the Roaming Photographer on-site and ready to capture moments at least 10 minutes before the time agreed upon. (Should you require the photographer to be set up earlier or if you’d like downtime during the event, a $60/hour downtime fee will be charged.) The photographer will be operational for a minimum of 95% of the time set; occasionally, operations may be interrupted for equipment adjustments or brief breaks.

To protect expensive equipment, 29PM Photo Booth reserves the right to refuse to photograph guests who are unruly and/or have consumed excessive amounts of alcohol. Beverages will not be permitted near the photography equipment. Should the photographer or equipment be damaged in any way due to unruly guests or negligence on the part of the client or client’s guests, 29PM Photo Booth reserves the right to terminate the service period without a refund.

29PM Photo Booth will be providing agreed-upon hours of roaming photography service. Your gallery of lightly edited photos will be delivered within 1-2 weeks via a downloadable ZIP file and an online gallery link.

COST & PAYMENT:

The minimum booking period for the Roaming Photographer is 3 hours within 30 miles of Upland, California. Any additional miles outside of Upland, California will incur an extra $3/mile fee. A retainer of 40% of the total amount is due at the signing of this contract to reserve your date. The remaining balance is due no later than one week before the event. The client will be charged a $30 fee for any returned checks. Please note that the retainer is non-refundable.

Customization: Clients may discuss specific photography requests or themes in advance to tailor the experience to their event.

MODEL RELEASE:

The client agrees to and understands the following: All guests captured by the photographer hereby give 29PM Photo Booth the right and permission to copyright and use photographic portraits or pictures of any event attendee who may be included, intact or in part, made through any and all media now or hereafter known for illustrations, art, promotion, advertising, trade, or any other purpose. In addition, the client hereby releases, discharges, and agrees to save harmless 29PM Photo Booth from any liability that may occur or be produced in the taking of said pictures or in any subsequent processing thereof, as well as any publication thereof, including, without limitation, any claims for libel, invasion of privacy, or any other cause of action.

ADDITIONAL TERMS:

Weather Considerations: The client is responsible for providing a sheltered area if the event is outdoors to protect the equipment from inclement weather. Should the event be canceled due to weather, the deposit remains non-refundable but can be applied to a rescheduled date.
Client Responsibilities: It is the client’s responsibility to inform the photographer of any important guests or moments that they would like to be captured during the event. The photographer will do their best to capture all key moments but cannot be held responsible for missed shots if not informed.
Disputes: Any disputes regarding the service provided must be raised within 7 days of the event. 29PM Photo Booth will work with the client to resolve any issues, but the decision of 29PM Photo Booth will be final.
